Surely the protesters are misdirecting their protest... VCAT overturned the council's veto, but all the council had to do to avoid a VCAT appeal, was rezone the land. (Basically what the retiring VCAT President, Justice Stuart Morris said in a recent interview on the 7.30 Report).

Looks like the council is having it both ways. Being seen to be against the Maccas, but not using their power to ensure that the Maccas does not go ahead...clever bit of deflecting, making VCAT and Maccas the bad guys while at the same time increasing council revenue.

Somewhat OT, but Stuart Morris actually stepped down as chair of VCAT six years ago.

In fact I was somewhat annoyed (but not, ultimately, surprised) to see him representing a big developer at a planning panel hearing I presented to, only a couple of months after his VCAT term had ended.

My reply was a bit bleary eyed last night. I couldn't remember the name of the President of VCAT, did a google search and incorrectly attributed the view expressed in the interview to a 'retiring' Stuart Morris. In fact I meant to cite the existing President of VCAT Justice Greg Garde.

Tacoma Macdonalds/Yarra Ranges Council is discussed from 3.50 to 6.30.

In retrospect, if the council had rezoned the land to stop the Maccas, it's possible they would have been liable to some kind of legal action.
